1.1 Registration. If you wish to participate in the mining machine bidding activity published on the Bitdeer official website, you should register on the bidding webpage before the deadline for bidding application announced in the official website notice. Your registration and subsequent actions on the Bitdeer official website are subject to the "Bitdeer Service Agreement” and “Privacy Policy” of the Bitdeer official website. You agree that during the registration process, Bitdeer has the right to request you to provide relevant information according to the “Know Your Customer” and “Anti-Money Laundering” rules and policies. You hereby confirm that you have full civil conduct capacity, good social reputation and payment ability, and the source of funds is legal, and you have the qualifications of the transferee in accordance with the relevant laws, regulations, and the provisions of these Rules. You agree to abide by the laws and regulations and the provisions of these Rules during the bidding process, and will exercise the rights you have according to the laws and regulations and the relevant rules and fulfill the obligations you have.
1.2 Deposit Payment. To ensure the order of bidding, you understand and agree that Bitdeer has the right to require Bidders to pay a deposit before participating in the bidding according to the type and quantity of the auction item.
2.1 Bidder shall participate in the mining machines bidding activity through the Bitdeer official website within the specified bidding time.
2.2 Once you have placed and confirmed a bid, your bid cannot be retracted. Any bid you make is an invitation to buy. Once your bid is the highest and accepted by Seller, a binding contract is established between you and Seller. So please bid with caution. Before confirming your participation in the bidding, Bidder should carefully read the information about the auction item, the bidding rules, auction process, precautions and other relevant content and requirements published on the bidding page, and carefully consider the various risk factors of the auction item. If you have any questions, please inquire through the contact information published on the page. Your participation in the bidding activity indicates that (1) you accept the current status of the auction item and all known and unknown defects of the auction item, and (2) if you are a Winner Bidder, you are willing to purchase the auction item as it is.
2.3 The specific bidding rules are subject to what is displayed on the bidding page.
2.4 You agree to participate in the online bidding according to these Rules, as well as all other rules and operating procedures that have been published or may be published on the Bitdeer website in the future, and comply with all kinds of rules in connection with bidding, price and deposit compensation. During the bidding period, you shall not hinder others from bidding, and you shall not engage in illegal activities such as collusion with other bidders or maliciously suppressing prices. In the event of your violation of the foregoing rules, Bitdeer has the right to cancel your bidder qualification and hold you legally accountable. If any abnormalities occur during the bidding process, Bitdeer has the right to determine that the bidding for the auction item is invalid and re-organize the online bidding.
2.5 In special circumstances, Bitdeer has the right to make a decision to suspend or withdraw the bidding for the auction item before the online bidding commences. Once such decision is made, Bitdeer shall not assume any other responsibilities except for the refund of the deposit (without interest). If there are any corrections or supplements to the description of the auction item, Bitdeer may inform the Bidders by displaying such corrections or supplements on the bidding page before the online bidding commences. Any Bidder who continues to participate in the bidding is deemed to have accepted such correction or supplement.

If you are the successful bidder for an auction item (the "Winning Bidder"), you agree to pay the Seller the full winning bid amount, plus any sales or other taxes applicable to your purchase, and any applicable shipping or delivery charges. You agree to abide by the Seller's requirements regarding payment method and payment schedule (the Winning Bidder shall be bound by the Mining Machine Purchase and Sale Agreement between it and Seller). The Winner Bidder will have their deposit automatically converted into a part of the purchase price. Bitdeer will contact the successful bidder, who must pay the remaining amount of the auctioned item (cryptocurrency payments should be made within 24 hours, USD wire transfers within 72 hours, or within another timeframe agreed upon in writing by both parties) after winning the bid. If the Winner Bidder fails to pay the remaining purchase price of the auction item as agreed, it will be considered as a breach of contract, and the deposit paid by the Winner Bidder will be forfeited by Bitdeer as a penalty and will not be refunded. In the event of a breach of contract by the Winner Bidder, Bitdeer has the right to decide (in its sole discretion) to re-organize the online bidding for the auction item or to notify and invite the Bidder with the next highest bid to purchase the auction item.
If you fail to successfully bid for the auction item, you can contact Bitdeer through the bidding page to apply for a refund of the deposit (without interest). The deposit will be returned to your wallet address based on the actual amount of USDT received by Bitdeer. If it is technically impossible to return it through the original route, you will be required to provide another wallet address to receive the refunded deposit. You confirm that you will comply with relevant anti-money laundering laws and regulations and agree to cooperate with Bitdeer to provide necessary information to meet funds compliance purpose.
The online bidding function provided by Bitdeer on its official website will be provided on an "as is" and "as available" basis. Bitdeer will make commercially reasonable effort to provide corresponding security measures based on existing technology to ensure the safety and normal operation of the service. However, due to possible factors such as computer viruses, network communication failures, system maintenance, and possible force majeure events, Bitdeer hereby expressly declares that it does not make any express or implied warranties for the technology, including but not limited to the applicability of the technology, no errors or omissions, continuity, accuracy, reliability, and fitness for a specific purpose. In this regard, the Bidder understands and agrees not to require Bitdeer to assume responsibility under the following circumstances:
6.1 Issues caused by your browser incompatibility, improper mobile phone operation, or mobile phone version;
6.2 System server downtime for maintenance;
6.3 Failure of communication terminals or telecommunication network equipment to transmit data;
6.4 System obstacles that cannot provide services due to force majeure factors such as typhoons, earthquakes, tsunamis, floods, power outages, war, terrorist attacks, etc.;
6.5 Service interruptions or delays caused by reasons such as hacker attacks, virus Trojan programs, technical adjustments or failures of telecommunications departments, website upgrades, third-party issues, etc.
7.1 These Rules are governed by the laws of Singapore. Any dispute arising from or related to these rules, including any question regarding their existence, validity, or termination, shall be submitted to the Singapore International Arbitration Centre ("SIAC") for arbitration and finally resolved in accordance with the SIAC Rules in effect at the time. The place of arbitration should be Singapore. The language of arbitration should be English. The cost of arbitration should be borne by the losing party. The losing party should also compensate the winning party's legal fees and other expenses. All claims and disputes within the scope of this arbitration clause must be arbitrated on an individual basis and not on a representative or collective class basis. Only individual relief is available, and claims of more than one person, or entity cannot be arbitrated or consolidated with those of any other person, or entity.
7.2 The content of these Rules includes the main text of the rules, as well as all other rules and operating procedures that Bitdeer has published or may publish in the future. All such rules are an integral part of these Rules and have the same legal effect as the main text of the Rules. Bitdeer has the right to formulate, modify these Rules and operating procedures from time to time as needed. Any revision, new rules and procedures will automatically take effect upon publication and become a part of these Rules. If you continue to participate in online bidding, it is deemed that you have no objection to the modified rules and agree to comply with them.
